The legal basis for the processing is the execution of a contract to which the data subject is a party.
- Responding to requests for information and/or queries made by the User. The data processed for this purpose will be kept for the legally established retention and limitation periods. The legal basis for the processing is the User's consent.
- To keep the User informed, including by electronic means, about the products, services, and news of viajespatas. The data processed for this purpose will be kept until the User withdraws their consent. If the User consents to the processing of their data for this purpose, they must check the box provided for this purpose on the Website. The legal basis for the processing is the User's consent. If a resume is sent through this Website, the data provided by the Data Subject will be processed to respond to their job application. The data processed for this purpose will be kept until the Data Subject revokes their consent or until 24 months have passed since its receipt.
Data category
Among the categories of data processed by VIAJES4PATAS and during the provision of the requested services, identifying data and other data such as geolocation data may be processed. The geolocation function will depend on the terminal equipment (computer, mobile phone, tablet, etc.) used by Users in connection with these services. That said, the processing of this personal data (geolocation) will be carried out by those companies (Apple Inc., Google Inc., etc.) that provide services related to the operating system of the terminal equipment used by the User.The User will be responsible for activating or deactivating the geolocation function according to the characteristics of their terminal equipment or device. The User must consult the privacy policy of the companies indicated above, as well as the conditions of the geolocation function, and give their express consent to the processing of this data. Other special categories of data that Users may exchange between Travelers and Owners in their communications to facilitate their relationship may also be processed, and the Owner is responsible for processing this data for the purposes included in this platform.
Communications and transfers
The Traveler User knows and accepts that VIAJES4PATAS may communicate their data to the Owner Users of rural accommodations whose rural houses are published on the Portal (hereinafter, 'the Owners') and with whom the Traveler User contacts (hereinafter, "the Travelers") for the purpose of processing the reservation or responding to any queries made by the Travelers.
The interested party may exercise their rights of access, rectification, deletion, limitation, opposition, or portability at any time by sending an email to contacto@viajes4patas.com.
All accommodation owners are informed that VIAJES4PATAS will be considered the data processor for all personal data owned by the owners to which it has access during the provision of the services offered.In this regard, the contract is formalized under the provisions of the General Data Protection Regulation at the time of registration on the platform and service by accepting the Privacy Policy. The terms are as follows:
a) VIAJES4PATAS shall process personal data only in accordance with the instructions of the Owners for the purpose of providing the service, including with regard to the transfer of personal data, unless it is required to do so by Union or Member State law; in which case, the Provider shall inform the Owners of this legal requirement prior to processing, unless such law prohibits it for important reasons of public interest.
b) Ensure that persons authorized to process personal data have committed themselves to confidentiality or are subject to a statutory confidentiality obligation.
c) Take all necessary measures in accordance with Article 32 of the Regulation.
d) Not subcontract the processing of data to other processors without prior authorization. When the Processor uses another processor to carry out certain processing activities on behalf of the Owners, it shall impose on this other processor, by contract, the same data protection obligations as those stipulated in this Agreement. If that other processor fails to comply with its data protection obligations, the Processor shall remain fully liable to the Owner for the fulfillment of the other processor's obligations. In any case, the data may be communicated to the following third-party recipients: Public Administrations for the fulfillment of legal obligations. In addition, they may be communicated to the following categories of processors: Electronic communications and online office automation providers, hosting, SaaS services such as CRM/ERP, management, accounting, auditing, and lawyers.
e) Assist the Owners, taking into account the nature of the processing, through appropriate technical and organizational measures, whenever possible, so that they can fulfill their obligation to respond to requests for the exercise of the rights of data subjects. In this case, VIAJES4PATAS must notify the Owners by email to their contact address. The communication must be made immediately and in no case later than the working day following receipt of the request, together with, where appropriate, any information that may be relevant to responding to the request.
f) Assist Owners in ensuring compliance with the obligations set forth in Articles 32 to 36 of the Regulation, taking into account the nature of the processing and the information available to the processor.
g) Unless otherwise indicated by the Owners, delete all personal data once the provision of the Services has ended, as well as delete any existing copies, unless the retention of personal data is required under Union or Member State law.
h) Make available to the Owners all information necessary to demonstrate compliance with the obligations laid down in Article 28 of the Regulation, as well as to enable and contribute to the performance of audits, including inspections, by the Owners or another auditor authorized by them.
i) Immediately inform the Owners if, in the opinion of VIAJES4PATAS, an instruction infringes the Regulation or other provisions on data protection of the Union or the Member States.
j) Comply with any other obligations incumbent upon it under current data protection regulations.
k) Notify the Owners, without undue delay and, in any case, within a maximum period of 48 hours, by email, of any breach of personal data security of which it is aware, together with all relevant information for the documentation, resolution, and communication of the incident.
The Owners undertake to comply with all applicable laws and regulations, accepting responsibility for any breach of such laws and regulations, and shall hold VIAJES4PATAS harmless from any damages that may arise from such breach. Specifically, Owners must provide or allow VIAJES4PATAS access to data in order to provide the Services; Conduct an assessment of the impact on the protection of personal data of the processing activities to be carried out by VIAJES4PATAS, where appropriate; Make the appropriate prior consultations; Ensure, prior to and throughout the processing, that VIAJES4PATAS complies with the Regulation; Supervise the processing, including carrying out inspections and audits.The processing of personal data will be carried out solely and exclusively for the purpose of providing the Services. The data that may be provided may fall into the category of special data, and the category of data subjects may be the Users of the platform and their related information. The relationship will be governed by Spanish law and any disputes will be resolved in the courts of the domicile of VIAJES4PATAS.
Data contained in the portal
In general, prior registration by the User is not necessary to access and browse the contents of the Portal. However, the use of certain services and contents may be conditional upon prior registration by the User. In this case, the data entered by the User must be accurate, current, and truthful.
Once registered, the User may personalize their profile, providing certain personal information about themselves, including their name and surname(s), gender, age, date of birth, address, image, etc.
Furthermore, the User knows and accepts that by participating in opinion sections, uploading content to the Portal, making comments and/or contributions, as well as providing any other type of information through their public profile, their data and said content may be viewed, together with their username and profile photo, by other Users of the Portal.
Users agree not to provide any personal data considered specially protected under current data protection regulations (health, religion, sex life, ideology, etc.) through their profile.
Likewise, if the User provides VIAJES4PATAS with personal data relating to third parties, they must have obtained their prior and express informed consent. Otherwise, the User is strictly prohibited from providing personal data, including the image of third parties, when using the Portal and the services offered therein. The User undertakes to hold VIAJES4PATAS harmless from any possible claim, penalty, fine, or sanction that it may be obliged to bear as a result of the User's failure to comply with the obligation described in this paragraph.
